Licence terms

The Gizmohaus licence: one store per year, renewal, refunds and support.

Gizmohaus (the "Theme") is original work by Veloso Labs. It is licensed, not sold. These terms are published at https://velosolabs.com/gizmohaus/docs/licence-terms. Buying a licence means you accept them.

What a paid licence lets you do

While your licence is active you may:

install and use the Theme on one Shopify store that you own or run for a client, and on that store's development, staging and unpublished copies;
change the Theme's code, settings, templates and assets for that store;
download the new versions Veloso Labs publishes, and get support.

To use the Theme on another store, buy another licence.

Term, renewal and cancellation

A licence runs for one year from the day you pay and renews automatically each year through PayPal until you cancel it. You can cancel at any time in PayPal; the licence stays active until the end of the year you have paid for.

When a paid year ends without renewal, the licence code keeps working for 14 more days. After that you may keep using the last version you downloaded on that store, but updates, support and the licence code end.

Refunds

You can ask for a refund within 14 days of any payment, through the support form on velosolabs.com, and that payment is refunded in full. When a payment is refunded, the licence for that year ends straight away: stop using the Theme on that store and delete your copies.

Licence check

The Theme checks its licence code with velosolabs.com at most once every 7 days. The check sends the theme's name and version, your store's myshopify.com address and the licence code, from the browser of whoever is viewing the store; it sends nothing about your customers or orders. If the licence has been refunded or revoked, or the code is used on a store it wasn't issued for, the Theme shows a notice in the theme editor within 7 days. If velosolabs.com can't be reached, nothing changes.

A licence covers one store. velosolabs.com records the stores that run the Theme, so a code or licence used on a second store can be found.

Support

Support means help, through the support form on velosolabs.com, with installing, setting up and using the Theme's own features. We reply within two business days. It does not cover custom development, third-party apps, or changes you have made to the Theme's code.

What you may not do

You may not:

resell, sublicense, share, give away or publish the Theme or any modified version of it, in whole or in part, as a theme, template, starter kit or part of another product;
list, sell or submit the Theme or anything derived from it in any theme directory, app store or other marketplace, including Shopify's;
remove or change this licence or the copyright notices in the Theme's files.

Third-party components

Fonts from the Shopify font library, Shopify-hosted assets (such as the gift card QR code script and wallet badge) and any app blocks are provided by their own owners under their own terms. This licence does not cover them.

No warranty

THE THEME IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT. IN NO EVENT SHALL VELOSO LABS BE LIABLE FOR ANY CLAIM, DAMAGES OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT OR OTHERWISE, ARISING FROM, OUT OF OR IN CONNECTION WITH THE THEME OR THE USE OR OTHER DEALINGS IN THE THEME.

Nothing in these terms limits rights you have under consumer law that cannot be excluded, such as the Australian Consumer Law.

Ending the licence

The licence ends automatically if you break these terms. When it ends, stop using the Theme and delete your copies.
